Marietta, GA – Roadway reopens following an SUV and tractor trailer collision

Marietta, GA (October 30, 2023) – On last Tuesday, October 24, afternoon, an SUV got tucked under a flatbed tractor-trailer, forcing the closure of a stretch of Canton Road in Marietta.

The accident caused the closure of several blocks of Canton Road south of its intersection with the Canton Connector, between Sandy Plains Road and Ruby Street, for quite some time.

The tractor-trailer attempted to turn into oncoming traffic at around 5 p.m. Both lanes were obstructed by the tractor-trailer.

The SUV driver, according to the Marietta Police Department, was seriously injured.

Truck Accidents in Georgia

Commercial vehicles transport goods or passengers for a company or an individual. In other words, they are intended for business use rather than personal use. A commercial vehicle’s liability in an accident can influence how an accident victim seeks compensation.

It is not always clear who is to blame when a commercial vehicle is involved in an accident.

When two cars collide, one or both drivers are usually at fault. The at-fault driver(s) would then be held liable for the damages. This usually means that their car insurance company will cover the costs.

However, liability for a truck accident may fall on the driver, the company that employs the driver, or a third party, such as a manufacturer or mechanic.

You may be entitled to compensation if you were injured in a commercial vehicle accident. It is necessary to determine who caused the accident, who hired the driver, and what kind of insurance they have.

These details are not always easy to obtain on your own, which is why you should always contact a knowledgeable Truck Accident Lawyer as soon as possible to help with your case.

At The Mabra Firm, we have a team of Personal Injury Lawyers who specialize in representing victims of commercial trucking accidents.

Call The Mabra Firm today at 404-344-5255, and an experienced truck accident lawyer will handle your case and ensure you receive the monetary compensation you deserve for your losses.

Jackson, GA – Hit-and-run Driver Arrested After Killing A Woman In Her Driveway

Jackson, GA (October 24, 2023) – After a woman was discovered dead in her driveway on October 20, the Georgia Bureau of Investigation arrested a guy and charged him with murder and hit-and-run.

The GBI reports that the body of 51-year-old Brooke Bedard Sides was discovered by Butts County Sheriff’s Office deputies on Watkins Park and Pool Road in Jackson. They claim that Nathan Shane Upchurch, 50, ran her over as he was exiting an argument they had just had.

Hit-and-run Accidents in Georgia

While any car accident can be dangerous, hit-and-run accidents are particularly harmful. A hit-and-run occurs when one of the drivers involved flees the scene before the police can arrive to file an incident report. This is considered illegal in Georgia.

When there is a car accident, everyone involved is supposed to stop, check if anyone was injured, and immediately call 911. A hit and run derails this entire process, not to mention it can cost someone their life.

The law affords you the same legal protections regardless of whether or not the driver fled the scene. The most sensible action would be to remain where you are and wait for the police to arrive at the scene of the collision. Get the license plate number of the vehicle that impacted you if at all feasible.

When the hit and run is reported to the police, they will begin looking for the vehicle that struck you and fled the scene. Damaged vehicles typically don’t travel very far and can be easy to spot, so the sooner you contact the police, the sooner they can begin to look for the hit-and-run driver.

If you are the victim of a hit-and-run accident, do not hesitate to contact a professional Personal Injury Attorney for legal advice. You’ll need all the help you can get if the at-fault driver flees the accident scene before you can get any information from them. You will want the help of an experienced lawyer to make sure all of your losses are covered.

Regardless of whether or not the at-fault driver is ever found, make sure you speak with a lawyer before trying to proceed with filing your claim.

At The Mabra Firm, we have a team of Hit-and-Run Accident Attorneys who can help with the details of your case. Call us at 404-344-5255 to schedule a free consultation if you were involved in a hit-and-run accident.

Are You in Need of a Motorcycle Accident Lawyer in Decatur? Why Collaborate with a Motorcycle Accident Law Firm in Decatur? The Role of a Motorcycle Accident Lawyer in Decatur The Urgency of Contacting a Motorcycle Accident Attorney in Decatur Immediately Assistance During the Most Trying Moments Preventing the Loss of Crucial Evidence and Witnesses Observing the Statute of Limitations Zero Up-Front Costs Secure Your Complimentary Case Review at The Mabra Firm Today

Considering the importance of engaging a car accident attorney, the significance of retaining a motorcycle accident lawyer cannot be overstated. Partnering with a reputable motorcycle accident law firm in Decatur confers numerous advantages, not the least of which is their capacity to potentially secure a more substantial motorcycle accident settlement from the at-fault party’s insurance provider. Let’s delve into the various ways in which motorcycle accident lawyers can serve their clients:

The Role of a Motorcycle Accident Lawyer in Decatur In accordance with Georgia state law, the individual responsible for causing your injuries (the at-fault driver) is liable for compensating for the damages they have inflicted. If multiple parties bear responsibility for the accident, the legal obligation may be distributed among them proportionally, with each party assuming a share of the losses.

To recover compensation, injured parties are obligated to establish the following key elements of the case:

  1. The other driver is the root cause of the accident.
  2. The accident has resulted in damages.
  3. The extent of the damages justifies the amount of compensation sought.

Insurance companies often seek to argue that the motorcyclist shares fault for the accident. This ploy is employed in an effort to deny the claim or minimize the payout. If the claimant is found even partially at fault, it can significantly reduce the amount the claimant is entitled to receive.

Insurers may allege that the motorcyclist violated traffic regulations, such as:

  • Failing to signal intentions in traffic
  • Riding alongside more than one motorcycle in the same lane
  • Insufficient equipment on the motorcycle (e.g., inadequate night lights, windshield, or helmet)
  • Failing to yield right of way

Proving one’s innocence in a motorcycle accident case is far from straightforward. This is precisely why it is imperative for the victim to promptly seek the counsel of a Decatur motorcycle accident lawyer. An attorney can provide invaluable assistance in a multitude of ways, including:

  • Collating evidence from the accident scene
  • Leveraging the police report to guide investigations
  • Identifying witnesses and procuring their testimonies
  • Locating nearby surveillance footage and securing copies of pertinent recordings

Why Should You Reach Out to a Motorcycle Accident Attorney in Decatur Without Delay? At The Mabra Firm, we are resolutely committed to safeguarding the interests of our clients and leaving no stone unturned in the pursuit of a victory. Initiating your motorcycle accident lawsuit at the earliest juncture significantly enhances your prospects of success, which is why we consistently recommend promptly consulting an attorney after your accident.

Legal Assistance During the Most Trying Moments Motorcycle accidents frequently result in more severe injuries compared to other vehicular accidents, often leaving victims grappling with excruciating pain and disorientation. These circumstances can lead to critical errors and the inadvertent oversight of crucial case details. Consequently, initiating contact with a motorcycle accident law firm in Decatur at the earliest opportunity represents the safest course of action.

A Decatur motorcycle accident lawyer can guide you through the intricate processes associated with interacting with insurance companies and law enforcement. By enlisting their services, you can remain focused on the essential facets of your case and steer clear of distractions. A legal expert can help you file your claim, accumulate and preserve vital evidence, and offer representation in court. This underscores the significance of aligning with an accomplished motorcycle accident lawyer from the very outset.

Preventing the Loss of Crucial Evidence and Witnesses Securing evidence and witnesses is generally more feasible immediately following an accident. Surveillance recordings may be deleted, and eyewitnesses tend to forget pertinent details over time. Consequently, it becomes increasingly challenging to amass essential evidence as months or years elapse.

An experienced motorcycle accident attorney in Decatur will initiate the evidence-gathering process promptly to expedite your compensation claim. The sooner you retain the services of a lawyer, the greater the window of opportunity to locate witnesses and accumulate the proof essential for a successful case outcome.

Time is not on your side following an accident.

Observing the Statute of Limitations Georgia’s legal framework delineates specific deadlines for the submission of claims. In most personal injury cases, GA Code Section 9-3-33 stipulates a two-year window for claims, while GA Code Section 9-3-32 extends a four-year period for property damage claims. The countdown commences from the date of the accident.

Hence, securing the services of an attorney immediately after your accident is highly advisable. A motorcycle accident lawyer in Decatur can assist you in initiating your claim and securing compensation before the statute of limitations expires.

You may be wondering about the costs associated with hiring a motorcycle accident lawyer.

Wrongful Death Lawyer Marietta

Seeking justice after the tragic loss of a loved one due to wrongful death is an immensely challenging endeavor. The grief and emotional turmoil, coupled with the complexities of legal proceedings, can be overwhelming. At The Mabra Firm, our dedicated team of wrongful death attorneys in Marietta is here to offer you support, guidance, and legal expertise during this difficult time.

Statistics: In 2018, Georgia recorded 1,507 deaths resulting from traffic accidents alone. This staggering number represents only a fraction of potential wrongful death cases, highlighting the need for experienced legal representation.

Understanding Wrongful Death: Wrongful death cases arise when the accused party owed the deceased a duty of care but, due to negligence, failed to meet that obligation, leading to the fatality. Here are some common scenarios that can result in wrongful death:

Traffic Accidents: If your loved one lost their life in a traffic accident due to another driver’s reckless or careless behavior, you may have grounds for a wrongful death claim. This can include situations where the other driver was distracted (e.g., texting while driving) or impaired (e.g., under the influence of drugs or alcohol).

Medical Malpractice: Medical malpractice occurs when a healthcare professional fails to provide reasonable care to a patient, leading to death. Common examples include surgical errors and misdiagnoses.

Workplace Accidents: Employers are responsible for their employees’ safety to some extent. If a workplace accident results in a fatality due to unsafe conditions or inadequate safety measures, it may constitute wrongful death.

Why You Need an Attorney: Working with an experienced wrongful death attorney in Marietta is crucial for several reasons:

Proving Your Case Is Complex: To establish wrongful death, you must prove three key elements: duty of care, negligence, and causation. This often involves demonstrating the absence of proper care, which can be challenging. Attorneys are well-versed in gathering evidence and building a compelling case.

Quantifying Due Compensation Is Difficult: Calculating the compensation owed in a wrongful death case is not straightforward. It may encompass medical bills, funeral expenses, lost income, and emotional distress, which can be challenging to quantify. Attorneys can help you compile the necessary documentation and determine a fair amount.

Insurance Companies Have Their Attorneys: In most cases, the accused party’s insurance company is responsible for providing compensation. These companies have their own legal representatives focused on minimizing settlements. Facing them without your attorney can put you at a disadvantage.

Choose The Mabra Firm: The Mabra Firm is here to advocate for you during this challenging time. Our attorneys have a proven track record in handling personal injury claims, property damage claims, and wrongful death claims in Georgia. You don’t have to face this battle alone.

Frequently Asked Questions: Facing a car accident can raise numerous questions about the legal process. Our experienced car accident lawyers are here to answer some of your most common queries:

What Do You Do After a Car Accident in Douglasville? The moments following an accident are critical. Follow these seven steps recommended by our car accident lawyers in Douglasville:

  1. Call 911 for immediate medical assistance.
  2. Collect the other driver’s information, including their name, phone number, address, license plate number, and insurance company.
  3. Preserve evidence by not allowing anyone to touch your vehicle or the accident scene.
  4. Share details of the accident with the responding police officer to create a police report.
  5. Document the scene by taking pictures.
  6. Contact your insurance company.
  7. Consult with a car accident lawyer before speaking to anyone else.

How Does a Car Accident Claim Begin? The process begins when you file a summons and serve a complaint to the at-fault party. However, there are exceptions, such as multi-vehicle accidents or when the at-fault party is an employee.

What are Damages in Car Accident Cases? Car accident cases may involve two types of damages: general and special damages.

General damages encompass physical injuries and non-tangible losses such as pain and suffering, loss of consortium, disfigurement, mental trauma, and PTSD.

Special damages include tangible losses like medical bills and property damage, such as vehicle repairs.

Is My Car Accident Case Criminal or Civil? Car accident cases can be categorized as either criminal or civil. Criminal cases are usually initiated by the state and involve violations like DUI. Civil claims are pursued through a law firm or independent party to seek compensation for injuries and damages.

What Are the Tort Laws? Tort laws address personal injury caused by negligence. Negligent tort law applies to motor vehicle accidents when a driver fails to follow road safety rules, resulting in harm to others or their property.

Will My Case Go to Trial? Most cases are settled before reaching trial. A trial is typically reserved for cases with significant legal issues. An amicable settlement between parties is often preferred.

What Are The Statute of Limitations in Georgia? In Georgia, you have two years to file a claim for damages or wrongful death after an accident. After this period, you may lose your eligibility to pursue compensation.

What Is Comparative Negligence in Douglasville, GA? Comparative negligence comes into play when both parties share fault for the accident. The jury determines the percentage of fault for each party, impacting the amount of damages awarded.

Should I Take the First Settlement Offered to Me? Insurance companies often offer low initial settlements. It’s advisable to consult with a car accident lawyer before accepting any settlement to ensure you receive fair compensation.

How Long Will It Take to Receive My Settlement? In Georgia, insurance companies have up to 40 days to settle a claim. After approval, you can expect to receive your settlement within six weeks to four months.

How Much Can I Get For A Whiplash Injury? Settlements for whiplash injuries can range from $3,000 to $10,000, depending on the severity of the injury. Mental trauma can also be a factor in these claims.

How much Does a Car Accident Lawyer Cost? Many Douglasville lawyers work on a contingency basis, meaning they only get paid if you win your case. Their fee is a portion of your settlement, and if you lose, you owe nothing.

How Can a Car Accident Lawyer Help? A car accident lawyer can navigate the legal complexities, maximize your compensation, and alleviate the stress of handling the case on your own.

Floyd County, GA – Motorcyclist Was Hit And Killed By A Truck Driver

Floyd County, GA (Sept. 26, 2023) – Kyle Holladay, a 34-year-old LaFayette resident, was killed in a motorcycle accident on Sept. 25, Monday morning close to Armuchee High School. Floyd County Police have accused a 46-year-old truck driver from Birmingham, Alabama with vehicular homicide.

The tractor-trailer, according to the police, was being operated by Tony Orlando McFarland when it collided with the victim’s motorcycle. According to the police, the truck driver was “closer than reasonable or prudent” to the motorcycle when he hit it and killed Holladay. Following the collision, the truck driver fled the scene.

McFarland is accused of hit-and-run causing serious injury or death, felony vehicular murder, and misdemeanor following too closely. As of Monday afternoon, he was still being held without bond.

The tragic collision happened not long after a pickup truck accident in the same vicinity. The pickup’s driver lost control, veered off the road, and collided with a utility pole’s guide wire. Wires were knocked across the road by the collision.

On Monday morning, Highway 27 was shut down near the collisions for a period of time.
